Notice to respondent No.3 is not necessary for the following reasons; Learned Additional Government Advocate raises a preliminary objection that the order under challenge is an order passed by the Tahsildar pursuant to an application made under Sections 128 and 129 of the Karnataka Land Revenue Act, 1964, for change in the mutation entry on the basis of succession. However, the Tahsildar has passed the impugned order rejecting the application on the ground that the layout has been formed on the land in question and sites have been allotted to the several persons by the Government. Learned Additional Government Advocate would therefore submit that the petitioner has to raise a challenge before the Assistant Commissioner under Section136(2) of the Act. - 4 - NC: 2026:KHC:5257 WP No. 28407 of 2025 HC-KAR
