Mr. Rakesh Kumar, learned counsel for the appellant, at the outset, has submitted that he may be allowed to withdraw this appeal, since, charge-sheet has not been submitted under the Scheduled Offences, rather, the charge-sheet has been submitted in other offences, therefore, he has sought for liberty to approach before the appropriate forum and for that purpose, he intends to withdraw this appeal. Such submission has been made in presence of learned State Counsel. Considering the submission made on behalf of the learned counsel for the appellant, the instant appeal is dismissed as withdrawn. However, liberty is being reserved to the appellant to approach before the appropriate forum for redressal of his grievance. In consequence thereof, I.A. No.13437/2024 stands disposed of.
