Learned counsel for the applicant undertakes to remove the defects, as pointed out by the office within a period of one week. This bail application has been filed on behalf of the applicant– Indramani Sheth @ Indramani Sethi @ Indramani Setha with prayer to release on bail in connection with N.C.B. Crime No. 02 of 2019 corresponding to N.D.P.S. Case No. 04 of 2019 registered under Section 8(c), 20(b) (ii) (C) of the Narcotic Drugs and Psychotropic Substance Act, 1985 pending in the court of Special Judge, NDPS, Latehar. Learned counsel for the applicant has submitted that the F.I.R. of the case was lodged on the complaint of NCB against the two named accused persons, namely, Md. Tohid and Md. Jahid who are driver and owner of the vehicle respectively. It is alleged that total 120 K.G. of ganja in 22 packets was recovered from the vehicle. It is also submitted that the co-accused Md. Jahid has been granted bail by a co-ordinate Bench of this Court in B.A. No. 8652 of 2019 vide order dated
26.09.2019. The name of the applicant is not figured in the F.I.R. It is further submitted that no narcotic substance was recovered from the possession of the applicant. The role which has been assigned to applicant is of supplying ganja to the accused persons of which there is no evidence. The applicant has been languishing in jail since 17.12.2020. The learned counsel appearing on behalf of the NCB vehemently opposed the contentions made by the learned counsel for the applicant and contended that the applicant is the hard core criminal and also having criminal antecedents. In reply, the learned counsel for the applicant has submitted that there is no previous criminal antecedents against the applicant and -2- all the cases have been slapped simultaneously after lodging of this case. In view of the submissions made and materials on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the court of learned Special Judge, NDPS, Latehar in aforesaid case.
