The petitioner is apprehending his arrest in connection with Kunda P.S. Case No.58 of 2024, for offence registered under section 8, 27, 28, 29, 30 of Narcotic Drugs and Psychotropic Substance Act, 1985 and section 33 of Indian Forest Act, 1927, pending in court of learned Sessions Judge, Chatra.

Learned counsel for petitioner submits that allegations are made that in the forest land poppy cultivation was done. He submits that the petitioner is nothing to do with the said cultivation and even land is not belonging to the petitioner and 11 persons are named in the FIR. He submits that even persons who have taken name of petitioner, their name has not been disclosed in FIR. He further submits that other co-accused have been granted anticipatory bail in ABA No.4683 of 2025.

Learned State counsel opposes prayer and submits that allegations are there of cultivating poppy plant.

Considering that petitioner is not having any criminal 1 antecedent as disclosed in para 25 of the petition and even land of the petitioner has been denied and it is alleged that in the forest area the said cultivation was done and the other co-accused have been granted anticipatory bail in ABA No.4683 of 2025, I am inclined to grant anticipatory bail to petitioners.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Sessions Judge, NDPS Cases, Chatra, in connection with Kunda P.S. Case No.58 of 2024, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.

This Anticipatory Bail Application is accordingly allowed and disposed of.
