Judgment
CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI For the Petitioners For the State : Mr. Prabir Kumar Chatterjee, Spl.P.P. :Mr. Randhir Kumar, Advocate 02/ 22.09.2025: Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners are apprehending their arrest in connection with Koderma P.S. Case No. 110 of 2025, registered under sections 303(2), 317(2) (4)/3 (5) of BNS, 2023, and section 26(1) (g), 41, 42 of Indian Forest Act, 1927(Bihar Amendment Act, 1989) and 27, 29 of Wild Life Protection Act, 1972, pending in the Court of learned Chief Judicial Magistrate, Koderma.
Learned counsel for the petitioners submits that the name of the petitioners has come in the confessional statement of the co-accused and blue stone has been recovered from the house of one Lalan Singh. He further submits that petitioners have no criminal antecedent which is disclosed in para 13 of the petition. On these grounds, he submits that the petitioners may kindly be provided privilege of anticipatory bail.
Learned counsel for the State opposes the prayer and submits that seeing the police party, the petitioners have fled away from the spot.
Considering that the name of the petitioners has come in the confessional statement of the co-accused and they have no criminal antecedent which is disclosed in para 13 of the petition, I am inclined to ( 2025:JHHC:29134 ) grant anticipatory bail to the petitioners. Accordingly, the above named, petitioners are directed to surrender before the learned court within three weeks from today and in the event of their surrender / arrest, the petitioners shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Koderma, in connection with Koderma P.S. Case No. 110 of 2025, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023. Dt.22.09.2025 satyarthi- ( Sanjay Kumar Dwivedi, J.)
