The petitioner apprehending his arrest in connection with Complaint Case No. 325 of 2018 for the offence punishable under Section 33 of Indian Forest Act, 1927 (Bihar Amendment Act, 1989), pending in the Court of learned Judicial Magistrate 1st Class, Koderma, has prayed for grant of anticipatory bail.
Having heard learned counsel for the parties and considering that it is a case under Section 33 of Indian Forest Act, 1927 (Bihar Amendment Act, 1989), without expressing any view on the merit of the present case, the petitioner is directed to appear and seek regular bail before the concerned Trial Court within three weeks, which shall be disposed of by the said Court in strict compliance of the guidelines laid down by the Hon’ble Supreme Court in the case of “Satender Kumar Antil Vs. Central Bureau of Investigation & Anr.” reported in 2022 (10) SCC 51 as well as the observation made in the case of “Satender Kumar Antil Vs. Central Bureau 1 of Investigation & Anr.” reported in 2024 (9) SCC
The present anticipatory bail application is, accordingly, disposed of with the aforesaid observation and direction. Vikas/ (Rajesh Shankar, J.) 2
