CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI For the Petitioner: - For the State:- 02/05.08.2025 --- Mr. Sahil, Advocate Mr. Prabhu Dayal Agrawal, APP ---- Heard the learned counsel for the petitioner as well as the learned counsel for the State.
The petitioner is apprehending his arrest in connection with Complaint Case No. 265 of 2024, registered for the offence under Section 26(1) (g) (d) (f) (h), 41, 42 & 52 of Indian Forest Act, 1927 (Bihar Amendment Act, 1989) and 27, 29, 31 & 51 of Wild Life Protection Act, pending in the court of learned CJM, Koderma.
Learned counsel for the petitioner submits that no such occurrence has been alleged in the offence report as above committed by the present petitioner and he has been implicated in this case merely on the basis of suspicion. He further submits that the allegations are made that the petitioner was identified while he was fleeing from the spot where the excavation of chips were made. He further submits that petitioner is not having any criminal antecedent which has been stated at paragraph 12 of this application. He further submits that petitioner is a business man and having his jewellery shop namely Kanchan Jewellers, on this ground he may kindly be considered anticipatory bail.
Learned counsel opposes the prayer for anticipatory bail and submits petitioner was identified while he was fleeing from the spot.
Considering the fact that the petitioner has got no criminal antecedent and it has also been pointed out the petitioner is a businessman and having his jewellery shop namely Kanchan Jewellers, I am inclined to allow the privilege of anticipatory bail to the petitioner. Accordingly, the petitioner- above named is hereby directed to surrender before the learned court within four weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned CJM, Koderma in connection with Complaint Case No. 265 of 2024, subject to the conditions as laid down under section 482(2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
