The petitioner is apprehending his arrest in connection with Herhanj PS Case No.07 of 2026, for the offence registered under section 17,18 and 29 of NDPS Act, pending in court of learned Special Judge, NDPS, Latehar.

Learned counsel for petitioner submits that the petitioner has been falsely implicated in this case alleging that the petitioner was doing cultivation of poppy plants in the forest land. He next submits that the petitioner is having no criminal antecedent which has come in the impugned order. He next submits that the co- accused persons have been granted anticipatory bail in ABA Nos.2460 of 2026, 3128 of 2026 and 3165 of 2026.

Learned State counsel opposes prayer and submits that allegation are there of cultivation of poppy plants in the forest land.

Considering that the land is of the forest department 1 and is not belonging to the petitioner and the petitioner has got no criminal antecedent as aforesaid and the co-accused persons have been granted anticipatory bail as aforesaid, I am inclined to grant anticipatory bail to petitioner.

Accordingly, petitioner, above named, is hereby directed to surrender before learned court within three weeks from today, and in event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of like amount each, to satisfaction of learned Special Judge, NDPS, Latehar, in connection with Herhanj PS Case No.07 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
