Judgment

Heard Advocate Shri R.L.Khapre for appellant, Advocate Shri S.R.Deshpande for respondent Nos. 2,3,8,11,12,14 to 16 and Shri R.V. Gaikwad for respondent Nos. 9 & 10. The appeal has been admitted for the question of calculation of share of appellant and his sisters in ancestral property. Advocate Shri Khapre states that the sisters could not have been given share equal to the co-parceners. Considering the fact that the appeal is admitted, though the partition proceedings i.e. demarcation is allowed to be carried out, the shares as per said demarcation shall not be allotted and the possession of present appellant shall not be disturbed until further orders of this Court. C. A. No. 5109/2006 is accordingly disposed of. /Diwale/ JUDGE
