Heard Shri Bhandarkar, the learned Advocate for the petitioner and Smt. B.H. Dangre, the learned Additional Government Pleader for the respondents.

The learned Advocate for the petitioner states that the petitioner vide application dated 30th October, 2009 applied to the Collector to permit the petitioner to convert the agricultural land into non-agricultural land and for grant of necessary sanction under the provisions of the Maharashtra Regional & Town Planning Act, 1966. It is further contended that the application/proposal of the petitioner has been forwarded to the Director, Town Planning, Pune by the Assistant Director of Town Planning for necessary orders vide communication dated 1st February, 2010.

The learned Advocate for the petitioner states that the said proposal is pending with Director, Town Planning, Pune till this 2 date. Hence, the petitioner is praying for direction to the said authority to decide the same within a stipulated period.

In the circumstances, we dispose of the petition with the following observations. The Director, Town Planning, Pune to decide the proposal of the petitioner, in accordance with law and procedure applicable in this regard, if not decided earlier. JUDGE JUDGE adgokar
