Heard. The petitioner has challenged order of attachment in respect of the property in the execution of the recovery proceedings in pursuance to Certificate issued U/s 101 of the Maharashtra Cooperative Societies Act, 1960. There is no challenge to issuance of the certificate itself. Thus, the challenge in the petition is to subsequent action which flows from the recovery proceedings. In absence of challenge to the main certificate, such petition regarding challenge to the recovery proceedings is untenable unless the recovery proceedings are otherwise shown to be bad in law.
