Case at a glance

Judgment

Mr. Mohan Bir Singh for the Petitioner/Applicant. Mr. Arshad Shaikh for the Intervenor. .... CORAM: DR. D.Y. CHANDRACHUD, J. 25th September, 2006. P.C. : This is a Motion for extension of time for effecting deposit before the Regional Provident Fund Commissioner. A total amount of Rs.32,29,351/- was directed to be deposited within a period of six weeks by the order of the Court dated 2nd August, 2006. An amount of Rs.15 lacs has already been deposited by a Pay Order dated 11th September, 2006; the deposit having been effected on 15th September, 2006. A balance of Rs.17,29,351/- is due and 2 payable. In addition, an amount of Rs.10 lacs is due to be deposited on account of damages under Section 14-B of the Employees' Provident Funds and Miscellaneous Provisions Act, 1952 by 27th September, 2006. Counsel appearing for the Petitioners has stated that the entire amount which is now due and outstanding shall be paid as directed by this Court by 5th October, 2006 and that no further extension would be sought. Having regard to the fact that the Petitioners have deposited an amount of Rs.15 lacs and since a ground of financial stringency was made before the Court, I am of the view that time to effect the balance payment be extended till 5th October, 2006. Ordered accordingly. The Motion is accordingly disposed of.
