P.C. 1 The petitioner has approached this Court with the apprehension that he will be falsely implicated in a case under NDPS Act or he may be eliminated by the underworld. This apprehension, on the part of the petitioner, arises from the case of his brother Mr. Suresh Kalyanji Bhagat, who was murdered on 13th June, 2008 by his ex-wife in connivance and conspiracy with the organized crime syndicate. The petitioner, therefore, prays that an umbrella of protection may be provided to him by the respondents. The petitioner is ready and willing to pay for the expenses that the State will incur for providing protection. 2 2 In our view such a writ cannot be issued by this Court. It will be proper that the petitioner makes an application to the Commissioner of Police, Mumbai, seeking police protection and on such application being made the Commissioner of Police can take necessary action as per the policy of the State. 3 With the aforesaid observations the petition is dismissed.
