Judgment

Operative part

Mr. N.N. Gavankar, instructed by Mr. Arfan Sait for the petitioner. Ms. Aparna Vhatkar, AGP, for the respondents. A.A. SAYED , JJ. CORAM: P.B. MAJMUDAR & P.C. DATE: FEBRUARY 24, 2011. The grievance of the petitioner is that the management i.e. Respondent No.2 has passed a resolution appointing the petitioner as the Headmaster of the said school for which approval has been sought for by respondent No.2 but the same has not been decided by the Education Officer (Secondary). In our view, the petition was required to be filed by the management and not by the teacher. However, we direct the Education Officer (Secondary) that in case any approval application has been submitted by respondent No.2, the same may be decided in accordance with law expeditiously and preferably within a period of three months from today. Subject to what is stated above, the petition is disposed of. P. B. MAJMUDAR, J. A.A. SAYED, J.
