We are informed that remedy of appeal is provided under section 406 of the Bombay Provincial Municipal Corporation Act, 1949. The petitioners shall, therefore, adopt the alternative remedy available to them, if they so desire. We make it clear that we have not expressed any opinion on the merits of the case and if the petitioners file any appeal, the same may be considered independently and in accordance with law. All contentions of the petitioners raised in the petition are kept in tact. If an application for interim relief is made, the appellate authority shall consider it expeditiously in accordance with law. The petition is disposed of. (R.V. More, J.) (Smt. Ranjana Desai, J.)
