The challenge in this writ petition under Article 227 of the Constitution of India is to an order of assessment dated 12th July 2003 passed by the respondent-Municipal Corporation. It is not in dispute that the order of assessment has been challenged by the petitioner by preferring an appeal under section 406 of the Bombay Provincial Municipal Corporation Act, 1949 and the said appeal is pending. 2 Hence, prayer clause (a) cannot be granted. ( 2) However, the appeal deserves to be expedited. Accordingly, it is directed that Municipal Appeal No.16 of 2003 shall be disposed of as expeditiously as possible and preferably before the end of this year. Petition is disposed of accordingly.
