This petition has been filed against an order passed under Section 78 of the Maharashtra Co-operative Societies Act,1960. The petitioner has admitted in the petition that the impugned order dated 23.12.2005 was received on 28.12.2005 and immediately on 29.12.2005 an appeal has been filed under Maharashtra Co-operative Societies Act before the Joint Divisional Registrar, Kolhapur Division, Kolhapur. It is stated that the said post is vacant and the charge :2: has been handed over to the Joint Registrar of Co-operative Societies Pune Division, Pune. The appellate authority from Pune was to visit Kolhapur on 30.12.2006 but for some reasons he could not visit. In the circumstances, it is directed that the appeal filed by the petitioner will be carried before the Appellate Authority at Pune on 9.1.2006. The appellate authority will consider the question of grant of ad interim relief on merits of the case on 9.1.2006 or on such other date which he may considers fit and proper or on other date which may be convenient to him. Till the question of grant of ad interim relief is decided, parties to maintain status quo as of today till next date. Subject to these directions, petition stands
