#1. This is an application essentially for grant of anticipatory bail. The applicant has approached this court directly without approaching the Sessions Court, I am therefore, not inclined to consider the prayer for grant of anticipatory bail. . There is also prayer that at the time of interrogation, investigation or recording of the statement of the :2: present applicant, the applicant may be permitted to remain present alongwith an Advocate of his choice at a visible distance and further directing that the enquiry, interrogation or recording of the statement be conducted only during the fixed office hours. The learned A.P.P. states that if the applicant’s advocate accompanies the applicant, he can remain at the visible distance and that the police would have no objection provided the advocate for the applicant should not interfere in the investigation, as the law in this regard is well settled by the Apex Court in various cases. The Advocate for the applicant states that he will appear before the Economic Offence Wing, Unit II, Crime Branch, C.I.D., Yellow Gate Police Station Building, 2nd floor, Carnac Bunder Road, Mumbai-400001, tomorrow at 11.00 a.m. It is made clear that there is no protection as against the arrest of the applicant in this application. Application is accordingly disposed of. :3:
