(Per the Hon’ble Mr Justice B.Prakash Rao) Since all the above appeals involve common question, they are taken up together for disposal. Heard Sri K.Ramanuja Chari, the learned Standing Counsel for A.P.Vikalangula Co- operative Corporation and the other counsel appearing on behalf of respondents/employees. All these appeals arise out of disputes for various benefits including continuance of service. However, subsequent to the disposal of the Writ Petitions, all these appeals have been filed. The learned Standing Counsel submits that the Government has taken a decision for appointing an Arbitrator and following the same, the Commissioner, Disabled Welfare & State Commissioner under Persons with Disabilities Act, 1995 and Functional Registrar under A.P.Cooperative Societies Act, 1964 has already issued proceedings dated 02.02.2006 and thereby an Arbitrator was appointed. Under the said reference, which was made under Section 61 of the A.P.Cooperative Societies Act, 1964, the Arbitrator has to go through all the aspects irrespective of the fact of any action taken at any level including the Government and has to resolve any dispute that may arise between A.P.Vikalangula Cooperative Corporation and its members, employees or debtors or creditors or shareholders, so that the disputes can be settled sooner at lesser cost. Having regard to the same, it is open for all the writ petitioners and the employees to appear before the Arbitrator and raise their claims. The same would be gone into and considered on merits and in accordance with law. In view of the same, all these appeals have become infructuous. Accordingly, all the Writ Appeals are dismissed as infructuous with liberty to the writ petitioners to agitate all such questions before the Arbitrator. No costs. It is needless to mention that till the disposal of all the cases before the Arbitrator, the interim orders granted by this Court pending these appeals shall continue to remain in force. _________________ (B.PRAKASH RAO, J) _____________ (D.APPA RAO, J) 15th February 2006 RRB
