aggrieved by the orders dated 02.07.2010 in I.A.No.1152 of 2009 in O.S.No.316 of 2007 passed by the Principal Junior Civil Judge, Nizamabad, where under the learned Judge dismissed petition filed by the petitioner to condone the delay of 128 days in filing the petition to set aside the exparte decree. Heard both sides. In the circumstances, the delay is condoned subject to the condition of the petitioner depositing 25% of the suit amount and costs within a period of four weeks. The amount so deposited shall be kept in fixed deposit and the same shall be payable to the party, subject to the result of the suit and suit itself must be disposed of within a period of six months from the date of receipt of a copy of this order.
