2. Heard Ms. K.Sesharajyam, leamed Senior Counsel representing Smt. Deepika Gadde, learned counsel for the petitioners appeared through video conference, and Mr.M Vivekananda Reddy, learned Assistant Public Prosecutor for respondent No. I -State.

3. Learned Senior counsel for the petitioners submitted that the petitioners have not committed any offence and they have been falsely implicated in the present cases. According to her, accused No.33 availed loan from the Charminar Co-operative Urban Bank Limited, Hyderabad for purchasing properties in the name of the petitioners. There are no allegations against the petitioners except that they were signatories to the documenfs. She further submitted that accused No.33 repaid the entire loan amount to the Charminar Co-operative Urban Bank Limited, Hyderabad. The Govemment had issued G.O.Ms.No.288 dated 20.02.2009 lor withdrawal of the case against the accused Nos.32, 34, 35,36 and 37. Accused Nos.32, 34, 35, 36 and 37 approached this Court and filed Crl.P.Nos.10995 of 2009 and 75'17 of 2010 for seeking quash of '-:tr-E 4 proceedings against them. This Court allowed tlr said criminal petitions by quashing the proceedings against t rc above said accused on 06.07.2010 and 27.10.2010 respectivel\ ,

She fu(her submitted that accused Nc 33 had also approached this Court and filed Crt.R.C.No.630 ol .009 aggrieved by the order passed by the leamed I Addition a Metropolitan Sessions Judge, Hyderabad in Crl.M.P.No.980 of 2 ) )8 in C.C.No.6 of 2002 and this Court allowed thc said Crt.R.C.Nc. ,30 of 2009 on

06.07.2010.l'he orders passed by this Court in Crl I .Nos. 10995 of 2009, 7577 of 2010 and Crl.R.C.No.630 of 200) have auained finality. Hence, continuation ol proceedingr; against the petitioners/acc used Nos. 38,39,42, 13,44,45,46 l cl 49 is a clear abuse o1- process of law and the saure is liable to bc ; rashed. 5 The leamed Additional Public Prosecutor 1z ir.ly submitted that the proceedings against the main accused N<..]3 and other accused are already quashed by this Court and the )etitioners are also entitled lor the very same relieL

Having considered the rival submissions nade by the respectiVe parlics and after perusing the materil I available on I 5 record, it reveals that very same allegations are levelled against accused Nos. 32, 34, 35,36 and 37 and the said accused have approached combined High Court ofAndhra Pradesh at Hyderabad and filed Crl.P.Nos.l0995 of 2009 and 7577 of 2010 and the same were allowed on 26.01 .2010 and 27.10.2010 respectively. Record lurther reveals that accused No.33 had also filed Crl.R.C.No.630 of 2009, aggrieved by the order passed by learned I Additional Metropolitan Sessions Judge, Hyderabad in Crl.M.P.No.980 of 2008 in C.C.No.6 ol 2002 dated 04.02.2009, wherein, erstwhile High Court of Judicature, Andhra Pradesh at Hyderabad was pleased to allow the said criminal revision case on 06.07.2010 and quashed the proceedings against accused No.33.

7. Hence, this Court is ol the considered view that continuation ofproceedings against the petitioners/accused Nos. 6, 9, 12, 38, 39, 42,43,44,45,46 and 49 would amounts to clear abuse ofprocess of law and it is liabte to be quashed

In the result, crirninal petition Nos. 12812 of 2014, 10512 ol 2014,12577 of2014,12961 of2014,13442of2014 and 14956 of 2014 are allowed and proceedings in C.C.No.6 of 2002 against the 6 petitioners/accused Nos. 6,9, 12,38,39, 42, 43, 4.1 15, 46 and 49 are hereby quashed.
