JUDGMENT:
(Per G. Bhavani Prasad, J) Heard Sri V.S.R. Anjaneyulu, learned counsel for the appellant and Sri Karanam Ramesh, learned Government Pleader for the respondent. The appeal arose out of the award in O.P. No.123 of 1983 on the file of the Subordinate Judge’s court, Tenali, dated 30-12- 1994 in pursuance of the common order in O.P. No.105 of 1983 and batch. The common order was in question before this Court in A.S. No.443 of 1995 and batch and a Division Bench of this Court by the common judgment dated 03-09-1996 dismissed the appeals by the Land Acquisition Officer and allowed the appeals and cross- objections by the claimants to the extent of fixing the market value of the land at Rs.23.50 ps. per square yard together with statutory benefits like additional amount, solatium and interest as per law. The said judgment had obviously become final. The present appeal by the claimant in O.P. No.123 of 1983 was on identical grounds in respect of the land covered by the same common order identical in all respects to the lands covered by the other cases and for the same reasons adopted by the Division Bench, the same relief should be granted to the appellant herein. Accordingly, the appeal is allowed declaring claimant/appellant to be entitled to the market value of the land in question at Rs.23.50 ps. per square yard together with all statutory benefits in accordance with law and the parties shall bear their own costs. _____________________ G.
