05.01.2022 ORDER This is an application under Section 438 Cr.P.C., praying for pre-arrest bail by the petitioner, namely, Kitab Ali @ Md. Kitab Ali, in connection with Abhayapuri Police Station Case No. 876/2021, registered under Sections 14/15 of the Assam Game Page No.# 2/2 and Betting Act, 1970. Heard Mr. A.S. Ali, learned counsel for the petitioner and Mr. R.J. Baruah, learned Additional Public Prosecutor, Assam for the Respondent State. The case diary produced has been perused. It appears from the materials available in the case diary that there is specific materials collected against the peititoner about his involvement with the alleged offence. It has also come out from the materials that the money collected through betting was deposited to the present petitioner and other co-accused got share thereof. It further appears from the materials in the case diary that the present petitioner is the kingpin in organizing the games and betting involved in this case. Considering such material in the case diary, this Court is of the view that this is not a fit case for grant of the privilege of pre-arrest bail. Accordingly, the prayer for pre-arrest bail made by the petitioner is rejected. The petition stands disposed of accordingly. Return the case diary. JUDGE Comparing Assistant
