Judgment
Heard Mr. J Payeng, learned counsel appearing for the petitioner. Also h eard Ms. S Sarma, learned State counsel for respondent No.1 as well as Mr. C Bar uah, learned Standing Counsel, APSC for respondent Nos.2 to 5, Mr. K Singha, lea rned counsel for respondent No.12, Mr. J Patowary, learned counsel for responden t No.13, Mr. TJ Mahanta, learned counsel for respondent No.15. The petitioner is a selected candidate in the ACS and allied services ex amination conducted in the year 2006, the result of which was published in the y ear 2010. It appears that the respondents have now carried out the exercise to f ind out as to whether the petitioner can be accommodated taking into account her merit position in the select list. It is submitted that as per the said exercis e it is found that the petitioner with Roll No.33035 securing 833 marks can be a ccommodated as Assistant Registrar of Co-operative Societies. However, she could not be offered appointment in view of the stay order operating in WP(C) No.2391 /2010 which has been disposed of today and the stay order has also been vacated. In view of the above, there is no impediment for the respondents towards appointing the petitioner in the post as reflected in the letter dated 27.2.201 2 addressed to the Government of Assam, Personnel (A) Department by the Secretar y, APSC. The writ petition is accordingly disposed of directing the respondents to appoin t the petitioner to the post against which she has been selected as expeditiousl y as possible preferably within 31.5.2012. The petitioner is also entitled to c onsequential benefit of seniority etc. in accordance with law.
