Heard Mr. C Baruah, learned Sr. counsel assisted by Mr. P Sarma, learned counsel appearing for the applicant. Also heard Mr. HK Barman, leaned S tate counsel appearing for respondent No.1 and Mr. SN Sarma, learned Sr. counsel assisted by Mr. A Sarma, learned counsel appearing for respondent Nos.2 to 5. This miscellaneous application has been filed for restoration of the connected writ petition being WP(C) No.4157/2008 which was dismissed for no n prosecution vide order dated 30.4.2012. Perused the statements made in the application. In view of the statements made on oath in the application, I am satisfied that this is a fit case to restore it on file. Accordingly, the order dated 30.4.2012 dismissing the writ petition for non-prosecution is recalled. C onsequently, the writ petition being WP(C) No.4157/2008 is restored to its origi nal number. This miscellaneous application is accordingly allowed and dispos ed of.
