Heard Mr PK Roy Choudhury, learned counsel appearing for the applicant. Also he ard Mr N. Goswami learned Standing Counsel, Assam State Electricity Board. This miscellaneous application has been filed for restoration of the writ petiti on being WP(C) No. 8449/2003 which was dismissed for non-prosecution vide order dated 06.02.2012. Upon perusal of the statements made on oath in the application, I am satisfied t hat this is a fit case to restore it on file. Accordingly, the order dated 06.02 .2012 dismissing the writ petition for non-prosecution is recalled. Consequently , the writ petition being WP(C) No. 8449/2003 is restored to file. This miscellaneous application is accordingly allowed and disposed of.
