JUSTICE DINESH KUMAR SINGH ORAL ORDER 08/ 11-09-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a complaint case in which cognizance has been taken for the offence punishable under Section 406 of the Indian Penal Code. It alleged the petitioner misappropriated Rs.14,37,000/- the sale proceeds of the land which he received by virtue of the power of attorney executed by the complainant in his favour. On the basis of submission of money receipt the anticipatory bail was granted to the petitioner by the learned court below on 25.11.2007, but subsequently the same was cancelled by the learned court below on 20.10.2011 when the money receipt was found to be forged. Patna High Court Cr.Misc. No.3749 of 2012 (8) dt.11-09-2012 Let the learned court below consider the regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Complaint Case No. 1212 of 2007 pending in the court of learned ACJM, Danapur.
