JUSTICE SHYAM KISHORE SHARMA : Mr. Abhay Kr. Thakur, Advocate. ORAL ORDER 5 28-11-2013 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. The FIR under Sections 302/34 of the IPC was lodged in which the petitioner was suspected to be involved in killing because the informant was having land dispute from before. Learned counsel appearing on behalf of the petitioner has submitted that the case was investigated and the police has submitted the final form. The cognizance was taken on complaint case and thereafter the case was proceeded. Learned counsel appearing on the informant has submitted that according to his information the trial has already been concluded. A report regarding status of the trial was called for Patna High Court Cr.Misc. No.24605 of 2013 (5) dt.28-11-2013 2 and that was sent to this Court on 21.10.2013 by the learned Judicial Magistrate, 1st Class, Saran, Chapra according to which the case is still pending for appearance of one co-accused. Considering the facts and circumstances of the case, the petitioner Mohan Mahto is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Chapra in connection with Complain Case No. 2449 of 2009, UT No. 195 of 2013, in Daudpur P.S.
