JUSTICE SHYAM KISHORE SHARMA ORAL ORDER 2 12-07-2013 Heard learned counsel for the petitioner and learned APP for the State. The petitioner is the sole named accused of the case registered under sections 366 and 363 of the Indian Penal Code wherein it has been alleged by the informant that his daughter had gone to Kali Mandir for Puja but she was forcibly taken away by the petitioner through a Bollero vehicle. Submission is that the victim has clarified the entire facts in her statement under section 164 Cr.P.C. Her school leaving certificate (Annexure-2) shows that she has quite grownup having her date of birth is 21.10.1993. She has stated that she was having intimacy with the petitioner and she has married with him. Considering the statement of the victim, petitioner above named is directed to be released on furnishing of Patna High Court Cr.Misc. No.28750 of 2013 (2) dt.12-07-2013 bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each satisfaction of learned C.J.M./concerned Court, Bhagalpur in connection with Kotwali (Adampur) P.S.
