JUSTICE RAKESH KUMAR ORAL ORDER 4 05-04-2013 Heard learned counsel for the petitioner and learned A.C. to Standing Counsel No. 23. In the present writ petition an order passed by Joint Director of Consolidation, Gaya, under Section 35 of the Bihar Consolidation of Holdings and Prevention of Fragmentation Act, 1956, is under challenge. In this case, till date no notice has been directed to be issued to private respondent. However, during the pendency of the present writ petition for adjudicating such dispute an appropriate forum as “Land Tribunal” has been constituted and functioning under the provision of Bihar Land Tribunal Act,
#2009. Accordingly the Court is of the opinion that this dispute Patna High Court CWJC No.10054 of 2008 (4) dt.05-04-2013 can well be adjudicated by the Tribunal.
