JUSTICE RAKESH KUMAR ORAL ORDER --------------------- 7 11-04-2013 Heard learned counsel for the petitioner, learned A.C. to Govt. Pleader no.13 as well as Sri Arvind Nath Pandey, learned counsel appearing on behalf of private Respondent no.5. The present writ petition is in relation to an order passed by the Director, Consolidation under Section 35 of the Bihar Consolidation of Holdings and Prevention of Fragmentation Act,
#1956. During the pendency of the present writ petition, for adjudicating such dispute, an appropriate forum as Land Tribunal has been constituted and is functioning under the provision of Bihar Land Tribunal Act,2009( hereinafter referred to as the 2 Patna High Court CWJC No.11876 of 2006 (7) dt.11-04-2013 “Act”). The Court is of the opinion that this dispute can well be adjudicated by the land tribunal. Accordingly, in view of provision contained in Section 15 of the Act, the Registry is directed to transmit the record of the case to the land tribunal forthwith. NKS/- (Rakesh Kumar, J)
