Operative part
Sri S.K.Rai, son of not known, resident of not known, Recovery Agent of respondent no.2. .... .... Respondent/s ====================================================== Appearance : For the Petitioner/s : None For the Respondent/s : Mr. Mukund Jee Mr. Rakesh Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE JAYANANDAN SINGH ORAL ORDER 3 18-11-2013 Learned counsel for the Bank appears and submits that the matter was passed over at the instance of learned counsel for the petitioner on the last date also. Today learned counsel for the petitioner is neither present nor any prayer is being made for accommodation in the matter. This writ application has been filed challenging the notice issued by the Bank under Section 13(2) of the Securitization & Reconstruction Of Financial Assets & Enforcement of Security Interest Act, 2002. From the pleadings it does not appear that the petitioner had filed any objection to the said notice in terms of Sub-Section Patna High Court CWJC No.10256 of 2007 (3) dt.18-11-2013 3-A of Section 13 of the Act. However, since learned counsel for the petitioner is not present today, the application is dismissed as not pressed. (Jayanandan Singh, J) Arvind/-
