ANJANA PRAKASH ORAL ORDER 7/ 03-09-2012 The Petitioner seeks transfer of Matrimonial Case No. 80 of 2011 from the Court of Principal Judge, Family Court, Nawadah, to equal jurisdiction of Court at Patna. In the nature of dispute between the parties, the matter was referred to the Patna High Court Mediation & Conciliation Centre, but unfortunately the matter could not be resolved and thereafter the parties submitted that the case be fixed in Chambers today so the parties would present themselves physically and attempt to resolve the dispute between them. The Petitioner despite the commitment has not appeared before this Court. However, the Opposite Party appears before this Court. Patna High Court MJC No.3847 of 2011 (7) dt.03-09-2012 2 It has been submitted on behalf of the Opposite Party that the matrimonial case, which is sought to be transferred, is at the fag end and, therefore, it may not be transferred to Patna. Counsel for the Petitioner submits that since there are two other cases pending at Patna, therefore, the present matter be also transferred to Patna. Considering that the case is at the fag end, I am not inclined to interfere in the matter. The application is dismissed with direction to the Principal Judge, Family Court, Nawadah, to expedite proceeding and conclude it positively within a period of three months from the date of receipt/ production of a copy of this order without granting unnecessary adjournments to any party, who intends to protract the proceeding.
