ANJANA PRAKASH ORAL ORDER 2 12-03-2013 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner seeks bail in a case instituted for the offence under sections 302, 201, 120-B/34 of the Indian Penal Code. Considering that the petitioner is a lady, without going into the veracity of allegation leveled against her, who is in custody since 4.6.2011, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) with two sureties of the like amount each or any other surety to be fixed by the court below to the satisfaction of the Ad- hoc Additional Sessions Judge, IInd, Gaya in connection with Sessions Trial No. 102 of 2011 arising out of Gaya P.S. Case No. Patna High Court Cr.Misc. No.6850 of 2013 (2) dt.12-03-2013 51/11 subject to the conditions mentioned below :- a) That one of the bailors will be a close relative of the petitioner, who will give an affidavit giving genealogy as to how he is related with the petitioner and another bailor shall be Chanchal Kumari, daughter of the petitioner. The bailor will undertake to furnish information to the court about any change in the address of the petitioner. b) That the petitioner will give an undertaking that she will receive the police papers on the given date and be present on date fixed for charge and if she fails to do so on two given dates and delays the trial in any manner, her bail will be liable to be cancelled for reasons of misuse. c) That the petitioner shall be physically present on each date during trial and if she fails to do so on two consecutive dates without any reasonable cause, her bail shall stand automatically cancelled.
