05.12.2012 Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner is in custody since 30.03.2012 in connection with alleged offences under Sections 272, 273, 279, 353, 307 I.P.C. and under Section 47 (A) of the Excise Act registered in connection with Jagdishpur P.S. Case No. 56 of 2012.

It appears that 9 gallons (270 litres) spirit was found to be carried on Bolero jeep without any documents in regard to which the petitioner has been implicated.

Learned senior counsel appearing for the petitioner invites attention to an order dated 10.10.2012 passed in Cr. Misc. No. 38903 of 2012 (Annexure-5) by which co-accused Chandan Kumar has already been granted bail by this Court.

Considering that bail has already been granted to similarly situated co-accused Chandan Kumar, let the Patna High Court Cr.Misc. No.46949 of 2012 (2) dt.05-12-2012 petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Jagdishpur P.S. Case No. 56 of 2012 on the following conditions- (i) That the petitioner will not indulge himself in any similar or other offence. (ii) One of the bailors must be a close relative of the petitioner. (iii) The petitioner will be well represented on each and every date and if he fails to do so on two consecutive dates, his bail bond will be liable to be cancelled by the Court concerned. Fahad.
