JUSTICE VIKASH JAIN ORAL ORDER 2 21-03-2013 Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest in connection with alleged offences under Sections 307, 324, 326, 34 IPC and 27 of the Arms Act registered in connection with Ara Nawada P.S. Case No. 342 of 2012.
Allegation is with regard to firing and causing injury upon the informant by the petitioner on the palm of the left hand and on the right side of chest by Shivjee Singh.
It is submitted that the entire allegation as regards the petitioner is concocted and is arising out of land disputes as he is the neighbour of the informant and has accordingly been falsely implicated. It is further stated that only one injury on the right side of the chest has been found in the medical report (Annexure- 2) which itself falsifies the allegations against the petitioner. Considering the above facts, in the event of the petitioner’s arrest or surrender within a period of 12 weeks from the date of communication of this order, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Ara Nawada P.S. Case No. 342 of 2012 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Vikash Jain, J) Chandran/-
