2005. Husband of the Complainant-Opposite Party No.2 was found traceless. While the matrimonial relation was existing, several allegations were leveled about demand of dowry including motorcycle and cash and causing of cruelty. Submission of learned counsel for petitioners is that there can be no probability of making any demand in absence of husband specifically when he is traceless. So, no question arises about causing of any cruelty for demand of dowry only. His further Patna High Court Cr.Misc. No.18676 of 2009 (4) dt.05-07-2012 2 submission is that in the instant case now complainant-opposite party no.2 has remarried with one Nagendra Prasad and after issuance of notice, she is not appearing in the Court as she is not interested in any way in prosecuting the case. If that is the reality, that can be verified by the Trial Court and, in case she is not interested to proceed with the case, complaint petition can be decided in its dismissal. With the above observation, this quashing application is disposed of. Let the order be communicated through Fax at the cost of the petitioners in the Court of S.D.J.M., Bettiah, West-Champaran connection with Complaint Case No. 2666C of
