JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 02-08-2012 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in Kankarbagh P.S. Case No. 45 of 2010 registered for the offences punishable under Section 364A/34 of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Patna. The accusation is of kidnapping the informant’s son on pretext of providing employment in the railway. The name of the petitioner sprang up in 164 Cr. P. C. statement of the victim. It is submitted by learned counsel for the petitioner that neither any extortion amount was paid to the petitioner nor it is alleged by the victim that the petitioner was also involved in demanding the extortion money. In view of this Court, it is a fit case for consideration of regular bail. Let the learned court below consider the regular bail of the petitioner if the petitioner surrenders within a period of six Patna High Court Cr.Misc. No.18267 of 2012 (3) dt.02-08-2012 weeks. With the above observation, this application is, accordingly, disposed off. Let the order be transmitted to the learned court below through fax at the cost of the petitioner.
