Heard learned counsel for the petitioner, learned counsel for the State as well as learned counsel appearing on behalf of the NHAI.
Learned counsel for the petitioner submits that the writ petition may be disposed of with liberty to the petitioner to file a appropriate application under 3G(5) of the National Patna High Court CWJC No.5149 of 2021(3) dt.16-07-2024 Highways Act, 1956 before the newly added respondent no. 8 (Divisional Commissioner, Magadh Division, Gaya). If the petitioner files an appropriate application within a period of six weeks before the newly added respondent no. 8, the respondent no. 8 is directed to dispose of the representation/application of the petitioner within a period of six months from the date of filing of such representation/application in accordance with law.
