Learned counsel for t he pet it ioners subm it s t hat a proposal for widening of NH- 309 at Tanda Chauraha- Chilkiya has been undert aken, pursuant t o which, a Not ificat ion dat ed 04.11.2025 has been issued 3 t he Aut horit ies. He furt her subm it s t hat t he pet it ioners, being aggrieved by t he said act ion of t he aut horit ies, m ade a collect ive represent at ion t o t he aut horit ies concerned, assert ing t hat t he pet it ioners are ent it led for relaxat ion from t he proposed widt h, as per Ut t ar Pradesh Road Side Land Cont rol Act , 1945 and Rule 7 of Rules, 1964 fram ed t hereunder.

Learned Governm ent Counsel as well as t he counsel appearing for NHAI subm it s t hat t he Com pet ent Aut horit y t o consider decide t he obj ect ions/ represent at ion, in t his regard, is Com pet ent Aut horit y Land Acquisit ion, as defined under Sect ion 3C( 2) of The Nat ional Highways Act , 1956, which reads as under: - “ 3C. Hearing of obj ect ions.- ( 1) … ( 2) . Every obj ect ion under sub- sect ion ( 1) shall be m ade t o t he com pet ent aut horit y in writ ing and shall set out t he grounds t hereof and t he com pet ent aut horit y shall give t he obj ect or an opport unit y of being heard, eit her in person or by a legal pract it ioner, and m ay, aft er hearing all such obj ect ions and aft er m aking such furt her enquiry, if any, as t he com pet ent aut horit y t hinks necessary, by order, eit her allow or disallow t he obj ect ions.”

Learned counsel for t he pet it ioner subm it s t hat 4 t he pet it ioners m ay be grant ed libert y t o obj ect ion/ represent at ions, as provided under Sect ion 3C( 2) of t he Act t o t he Com pet ent Aut horit y Land Acquisit ion, Nainit al and t he said aut horit y m ay be direct ed t o decide t he obj ect ion/ represent at ion in a t im e bound m anner.
5. Learned Governm ent Counsel as well as t he counsel appearing for NHAI subm it s t hat t hey have no obj ect ion t o t he said prayer m ade by t he learned counsel for t he pet it ioners.
7. Said subm ission placed record. Accordingly, t he pet it ioners are given libert y t o file obj ect ion/ represent at ion t o t he Com pet ent Aut horit y Land Acquisit ion, Nainit al wit hin a period of one week from t oday. I f pet it ioners m ake represent at ion wit hin one week, t he Com pet ent Aut horit y Land Acquisit ion, Nainit al shall decide t he sam e in accordance wit h law, wit hin one m ont h t hereaft er. Till t hen, no coercive st eps shall be t aken against t he pet it ioners.
