The petitioners have filed the instant application for the following reliefs: “(1) For issuance of an appropriate writ in the nature of Certiorari for quashing the notice dated

29.07.2021 in L.A. Case No. 11/2021-22 (Annexure- 4) issued by the respondent No. 6 (the Land Acquisition officer cum Competent Authority, Patna) whereby and whereunder the respondent No. 6 sent information to the petitioners to accept the compensation of the land of the petitioners under Mauza Bhergawan, thana No.. 73 and Mauza Bajidpur, thana No.77 respectively which have been fully described in para 8 of this writ application, on

13.08.2021 or before by producing the various documents for their claims from issuance of the said Patna High Court CWJC No.18974 of 2021(2) dt.06-04-2023 notice, treating, the land of the petitioner as agricultural in place of commercial/ residential thereby the amount calculated is miserable inadequate and in the contravention of the national Highways Act 1956 and Right to fair compensation and transparency in land Acquition, Rehabilition and Resettlement Act, 2013. Since the competent authority has not power to change the nature of the land which is admitted fact from the notified MVR Value of the aforesaid circle in which the land of the petitioners been described as Commercial/residential vide Letter No. 148 dated

04.02.2019 issued by the Circle Officer, Fathua (Patna). (II) For issuance of the writ in the nature of mandamus commanding and directing respondents authorities to pass an appropriate order on the objection filed by the petitioners before the District Land Acquisition Officer, Patna, Bihar in land Acquisition Case no. 11/ 2021-22 regarding to modify/change the compensation amount treating the land commercial/residential and thereby payment be made alongwith 12 % interest in view of the provision contemplated in the National Highways Act, 1956 as well as under right to fair compensation and transparency in land Acquisition, Rehabilitation and Resettlement Act, 2013. III) For restraining the respondents form taking any coercive (steps in terms of the impugned letter dated 29.07.2021(Annexure-4) till disposal of this application. (IV) To grant any other relief/s for which the Patna High Court CWJC No.18974 of 2021(2) dt.06-04-2023 petitioners be found entitled in the eye of law. In sum and substance, the submission on behalf of petitioners is that the petitioners are aggrieved by the determination of the compensation determined for payment to the petitioners by the Land Acquisition Officer-cum-Competent Authority, Patna. Learned counsel for the petitioners further submits that as per oral instructions received, the petitioners have already moved before the Arbitrator in terms of the provisions of section 3G(5) of the National Highways Act, 1956. It is finally prayed by learned counsel for the petitioners that the petitioners will be withdrawing this application to pursue his matter before the Arbitrator. Further, a prayer is made that some time may be fixed for conclusion of the proceedings by the learned Arbitrator. Having heard learned counsel for the parties and having perused the materials on record and the submissions made, this application is permitted to be withdrawn with the aforesaid liberty. It is directed that in case the petitioners have not moved under section 3G(5) of the National Highways Act, 1956, they will move before the Arbitrator within a period of four weeks from today. The learned Arbitrator will expedite the Patna High Court CWJC No.18974 of 2021(2) dt.06-04-2023 disposal of the case of the petitioners and dispose it of at the earliest preferably within a period of six months from the date of production/communication of this order.
