Judgment

In Re : An application for bail under section 439 of the Code of Criminal Procedure in connection with Bagnan Police Station FIR Case No. 285/2021 dated 09.06.2021, under sections 379/511/427 of the IPC and 15/16 of the Petroleum and Mineral Pipe Line (Acquisition of Right of user in Land) Act, 1962 and 3/4 of PDPP Act and 3/4 of the Explosive Substance Act, 1908. In Re : Abdul Ramij @ Gullu And …….. petitioner Mr. Soumik Ganguly Mr. J.S.Bhatt Mr. Neguive Ahmed Mr. Iqbal Kabir …… for the petitioner …… for the State The petitioner is in custody for 400 days. He prays for bail. Learned lawyer for the State opposes the prayer for bail. We have considered the materials on record. The petitioner is a member of organised racket who are engaged in pilferage of inflammable crude oil which was transported through pipeline. In view of the gravity of the offence and possibility of commission of similar offence if on bail, we are not inclined to grant bail the petitioner at this stage. Accordingly, the prayer for bail is rejected. (Ajay Kumar Gupta, J.) (Joymalya Bagchi, J.)
