Judgment

Heard learned counsel for the applicant and learned AGA for the State.

The applicant has approached this Court for getting a direction issued to the court of Judicial Magistrate-III, Lucknow, to decide the Case no.127604 of 2023 (Seedgrow Agri Gentics Vs. Rajesh Singh, Proprietor, M/s. Kisan Agro Traders, Gola Ghat, Opp. Gomti Hospital, Faizabad Road, District Sultanpur, U.P. 228001) filed under Section 138 of Negotiable Instrument Act.

The aforesaid case of the applicant is pending since 2023. Learned counsel for the applicant submits that under Section 143(3) of the N.I. Act, it is provided that every trial under this Section shall be conducted as expeditiously as possible and an endeavour shall be made to conclude the trial within six months from the date of filing of the complaint. He has submitted that since long time, the case is pending without substantial progress.

In view of the aforesaid facts, the court concerned is directed 2 A483 No. 1107 of 2025 to adhere to the provisions of Section 143(3) of the N.I. Act and accordingly expedite the proceedings of the aforesaid case in accordance with law, without granting any unnecessary adjournments to the parties.
