Judgment
Heard learned counsel for the petitioner and perused the material brought on record.
The present petition has been filed by the petitioner challenging an order dated 26.09.2018 (Annuexure N0.7) as well as the order dated 01.08.2019 (Annexure No.8), whereby, the suit preferred by the petitioner-landlord seeking a decree of ejectment came to be dismissed.
Considering the fact that concurrent findings were recorded, no interference is called for. However as, now the U.P. Act No. 13 of 1972 has been repelled by the new Tenancy Act of 2021, it is open to the petitioner to institute fresh proceedings, if so advised, under the new Tenancy Act, 2021.
In case, the proceedings are initiated, the same shall be decided expeditiously preferably within a period of six months, in accordance with 2 WRIA No. 32123 of 2019 law.
