Judgment
Heard learned counsel for the petitioner and learned Standing Counsel for the respondent/State.
Facts in brief as contained in the writ petition are that in the proceedings initiated by the petitioner before the Prescribed Authority/Controlling Authority under the Payment of Gratuity Act, 1972 in P.G.A Case No.12 of 2016, award dated 27.08.2022 has been made in favour of the petitioner by which a direction was given to the respondent No.4/Deputy Manager M/s Hind Agro Industries Ltd. and respondent No.5/Managing Director, M/s Hind Agro Industries Ltd. are directed to pay a sum of Rs.1,79,706/- to the petitioner as gratuity within a period of three week. Since the aforesaid order was not complied with, a letter dated 05.12.2025 has been written by Prescribed Authority Under Payment of Grautity Act, 1923 and Assistant Labour Commissioner, Aligarh to the Collector Aligarh to recover the aforesaid amount as per award dated 27.08.2022 and submit a Bank Draft of the aforesaid amount in favour of the Deputy Commissioner, Aligarh.
It is argued by learned counsel for the petitioner that considerable time has already been lapsed but till date no final decision has been taken in the matter.
On the other hand, it is argued by learned Standing Counsel that necessary decision will be taken in the matter by the respondent No.2/District Magistrate/Collector Aligarh expeditiously. 2 WRIC No. 34199 of 2025
