Judgment
Heard Mr. Abhishek Mishra, learned counsel for the petitioner.
The instant petition has been filed for the following relief:- "i. Direct the Respondent No.1 i.e. Rent Authority/Additional District Magistrate, City Gorakhpur to decide the application filed by the petitioner bearing application No.1600 of 2023 under Section 21 of the Regulation of Urban Premises Tenancy Act, 2021 in a time bound manner. "
Learned counsel for the petitioner submitted that the aforementioned Application No. 1600 of 2023 filed by petitioner before respondent No.1/ Rent Authority, Additional District Magistrate, City Gorakhpur, under Section 21 of the U.P. Regulation of Urban Premises Tenancy Act, 2021 is pending 20.07.2023. He further placed certified copy of the order sheet, which has been annexed as Annexure No.2 to the writ petition in order to demonstrate that the case is not proceeding expeditiously.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally directing respondent No.1/Rent Authority/ additional 2 WRIA No. 14267 of 2025 District Magistrate, City Gorakhpur to decide the aforementioned application No.1600 of 2023 in accordance with law expeditiously and preferably within a period of two months from the date of production of certified copy of this order after giving opportunity of hearing to both the parties.
