The instant writ petition has been preferred with the prayer to command the respondents to fix the compensation amount of the petitioner's land on the basis of market value (which is about 2 lakhs per feet) or fix the compensation amount equal to the amount fixed for the acquired land of adjacent villages.

An objection has been raised by learned Additional C.S.C. that compensation has been calculated by the National Highway Authority of India (in short 'NHAI'), however, in case petitioner is still aggrieved, he has alternative and equally efficacious remedy to raise his grievance before the Competent Authority under Section 3(G)(f) of the National Highways Act 1956.

Considering the factual situation and the relief claimed, without adverting on the merits of the case, we dispose of the writ petition with direction that in case the petitioner moves an appropriate application in accordance with law within ten days period, the same shall be decided on merits by the competent authority in accordance with law.
