Judgment

#1. Heard learned counsel for the parties and perused the record.

#2. The instant writ petition has been filed for following relief: "a) Issue a writ, order or direction in the nature of mandamus directing the respondent No.2 the Additional Commissioner (Judicial) First, Kanpur Division Kanpur to decide the Stay Application filed in appeal as well as appeal having Case No. 289 of 2024, Computerize Case No. C202403000000289 (Jagdish Singh and others Vs. Land Management Committee and others) under section 333 of U.P. Zamindari Abolition and Land Reforms Act, 1950, expeditiously with in stipulated period.. b) Issue a writ, order or direction in the nature of mandamus directing the respondents to not dispossess the petitioner from the land in question i.e. allotted land in pursuant to order dated 15.02.2021 passed by Additional District Magistrate (Judicial), Auraiya in Case No. 00084 of 2021, Computerize Case No. D202103050000084 (State Government Vs. Abbal Singh) under section 198(4) of U.P. Zamindari Abolition and Land Reforms Act, 1950, till the disposal of appeal pending in the court of Additional Commissioner (Judicial) First, Kanpur Division Kanpur."

#3. Contention of the learned counsel for the petitioner is that the aforementioned appeal is pending before respondent no.2 for adjudication. He prayed that the same may be decided expeditiously.

#4. No useful purpose would be served in keeping this petition pending.

The present petition stands disposed of finally with a direction to the respondent No. 2 to consider and decide the aforementioned appeal, in accordance with law, expeditiously, preferably within a period of three months from the date of production of a certified copy of this order after ensuring service upon all the respondents and after giving opportunity of hearing to the parties concerned provided that there is no other legal impediment.
