Judgment

Instructions filed by the learned Standing Counsel in Court today be kept on record. A copy of the same has also been handed over to the counsel appearing on behalf of the petitioner.

Heard learned counsel appearing on behalf of the parties.

Upon perusal of the instructions, it appears that the hypothecated assets are no longer in the premises for which an order under Section 14 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 has been passed.

Counsel appearing on behalf of the petitioner also submits that the borrower is absconding.

In light of the situations that are unfolded, we are of the view that the petitioner should seek alternative avenues to satisfy its outstandings.
