The order impugned reads as follows:- ्ቚेषक, जि(cid:6)ला अल्पसंख्यक कल्याण अधि(cid:19)कारी, कु शीनगर। सेवा में, रजि(cid:6)स्ट्रार, उ०्ቚ० मदरसा शिश्ቌा परीषद, 704 (cid:6)वाहर भवन लखनऊ। प्ቔांक 321/जि(cid:6)०अ०क०अ०/मद०्ቚत्या०/2002-23, दिदनांक- 11 (cid:6)ून, 2022 दिवषयः- मदरसा अंसारूल उलूम पचरूखिखया पोस्ट-शंकर पटखौली फाजि(cid:6)लनगर (cid:6)नपद- कु शीनगर की आखिलया स्तर की मान्यता दिनलቚኌ:;त दिकये (cid:6)ाने के स:;न्(cid:19) में। महोदय, सादर अवगत कराना है दिक मदरसा अंसारूल उलूम पचरूखिखया पोस्ट -शंकर पटखौली दिव०ख० फाजि(cid:6)लनगर (cid:6)नपद-कु शीनगर में आखिलया स्तर का मदरसा संचाखिलत है। उ्ሹ मदरसे का शिशकायत उसी ्ቇाम सभा के ्ቇामवाजिसयों ्ቛारा लगातार दिकया (cid:6)ा रहा है , "दिक भवन के नाम पर मानक दिवहीन 05 कमरे ;ने हुए हैं और जि(cid:6)स भूदिम पर मदरसे की मान्यता ली गयी है, उस पर खेती दिकया (cid:6)ाता है और जि(cid:6)स भूदिम पर मदरसा ;ना है, उस भूदिम पर भूदिम पर मा० न्यायालय का स्टे है" उ्ሹ शिशकायत के ्ቅम में दिदनांक -03.06.2022 को मदरसे के ्ቚ;न्(cid:19)क ्ቛारा कायाEलय में उपቚኌस्Fत होकर मदरसे से स:;ቚኌन्(cid:19)त दस्तावे(cid:6) ्ቚस्तुत दिकया गया जि(cid:6)सके अवलोकनोपरान्त यह पाया गया दिक मदरसा आखिलया स्तर के मानको को पूणE नहीं करता है , तFा मौखिखक सुनवाई के 2 उपरान्त उन्हें प्ቔ सं०-283 दिदनांक-04 (cid:6)ून, 2022 ्ቛारा (cid:6)वा; हेतु नोदिटस दी गई। परन्तु अ्ቕतन उनके ्ቛारा कोई उ्ቈर कायाEलय में ्ቚस्तुत नहीं दिकया गया है। अतएवं मदरसा अंसारूल उलूम पचरूखिखया पोस्ट-शंकर पटखौली कु शीनगर की आखिलया स्तर (1-10) तक की मान्यता दिनलቚኌ:;त करते हुए आवश्यक कायEवाही करने का क्ቖ करें। संल्ሿक- उपरो्ሹानुसार भवदीय, (लालमन) जि(cid:6)ला अल्पसंख्यक कल्याण अधि(cid:19)कारी, कु शीनगर। प्ቔांक व दिदनांक उपरो्ሹानुसार। ्ቚधितखिलदिपः- दिन:नखिलखिखत को सूचनाFE एवं आवश्यक कायEवाही हेतु ्ቚेदिषत। 1- ्ቚभारी अधि(cid:19)कारी स:पूणE समा(cid:19)ान दिदवस कसया कु शीनगर को इस अनुरो(cid:19) के साF दिक उ्ሹवत सन्दभE सं०-422 दिदनांक-04.06.2022 को दिन्ቌेदिपत करने का क्ቖ करें। 2- ्ቚ;न्(cid:19)क/्ቚ(cid:19)ानाचायE मदरसा अंसारूल उलूम पचरूखिखया पोस्ट -शंकर पटखौली फाजि(cid:6)लनगर (cid:6)नपद- कु शीनगर। 3- ्ቦी शौकत अली, ्ቇाम- पचरूखिखया, पो०-शंकर पटखौली दिव०ख०-फाजि(cid:6)लनगर (cid:6)नपद- कु शीनगर। ह०अप० जि(cid:6)ला अल्पसंख्यक कल्याण अधि(cid:19)कारी, कु शीनगर। A perusal of the order passed by the respondent no.3 reveals that it is a recommendation made to the Registrar of the U.P. Madarsa Education Board, respondent no. 2 for suspending the recognition granted to petitioner no.1 and for taking further action thereon. It is contended that without giving any opportunity of hearing, the impugned order has been passed which requires to be set aside. It is stated that the Madarsa, petitioner no.1 is complying with all relevant rules and there ought not to arise any question for de-recognition of the recognition granted to it under the provisions of the Uttar Pradesh Board of Madarsa Education Act, 2004 (hereinafter referred to as ‘Act of 2004’) read with the Uttar Pradesh Non-Governmental Arabic and Persian Madarsa 3 Recognition, Administration and Services Regulations, 2016 (hereinafter referred to as the Regulation of 2016). The Regulation 13 of the Regulation of 2016 reads as under:- “13. Suspension and withdrawal of recognition-(1) Inspector Arabic Madarsa or any other officer nominated by the Chairman or the Director may inspect the Madarsa at any time and documents of the Madarsa shall be provided for inspection. If any defect found during inspection or if it comes to the knowledge that the Madarsa is not complying with one or more conditions of recognition, the Registrar, Uttar Pradesh Madarsa Education Boards shall, on the report of the enquiry officer (Inspector Arabic Madarsa Uttar Pradesh) give written directions to the Madarsa for the removal of shortcomings. (2) The Registrar of the Board of Director ( Head of Department) shall on non-compliance of the conditions of recognition and order of the Board give notice to the Madarsa and if the reply of the Madarsa is found unsatisfactory or there is no reply within the stipulated time, Madarsa may be suspended after given notice. If the Board is, upon representation from the Madarsa management, satisfies that the Madarsa has complied with the conditions the suspension may be revoked. (3) If despite suspension of recognition by the Registrar, the Madarsa does not comply with the condition for 3 continuous years, the recognition committee of the board may withdraw the recognition but before doing so the management of the Madarsa shall be given reasonable opportunity of being heard. (4) If upon inspection during temporary recognition non- compliance of the conditions of recognition are found or the rule/conditions are not being followed, the Registrar shall give clear written direction for removal of anomalies to the concerned Madarsa and if the reply given in the prescribed period is found unsatisfactory or there is no reply, the Registrar with the approval of Recognition Committee by giving notice to the Madarsa shall withdraw recognition granted by it. (5) The restoration of suspended recognition of Madarsa shall not affect its seniority. (6) In case of withdrawal of permanent recognition, the institution shall not be entitled to any Government grant.” Evident it is that an elaborate procedure has been provided in the above provision for suspension or revoking the recognition granted to a Madarsa in which, steps are taken by the Registrar on the basis of an 4 inspection done by the authorized officer, notices are required to be issued and adequate opportunity of representation is provided to the institution to place its case before the Registrar. The order impugned is, however, is in the nature of recommendation alone and by it no action has yet been taken for suspension or withdrawal of the recognition. The writ petition is premature and is, accordingly, dismissed.
